Who are we?

‘We’, ‘us’ and ‘our’ refer to Moody Kiddell & Partners Pty Ltd ACN 003 168 394, Australian Credit Licence 388771 and our related bodies corporate. This includes MKP Corporate AFSL number 511595, ABN 33 615 318 039.


Our commitment to protect your privacy

We understand how important it is to protect your personal information. This document sets out our privacy policy commitment in respect of personal information we hold about you and what we do with that information.

We recognise that any personal information we collect about you will only be used for the purposes for which we have collected it or as allowed under the law. It is important to us that you are confident that any personal information we hold about you will be treated in a way that ensures its protection.

Our commitment in respect of personal information is to abide by the Australian Privacy Principles for the protection of personal information, as set out in the Privacy Act and any other relevant law.


Personal information

When we refer to personal information, we mean information from which your identity is reasonably apparent. This may include information or an opinion about you. The personal information we hold about you may also include credit information.

Credit information is information used to assess your eligibility to be provided with finance and may include any finance that you have outstanding, your repayment history, and any defaults. Credit information is usually exchanged between credit and finance providers and credit reporting bodies.

The kinds of personal information we may collect include your name, date of birth, address, account details, occupation, and any other information we may need to identify you.

If you are applying for finance, we may also collect information such as the ages and number of your dependants and cohabitants, length of time at your current address, your employment details, and proof of earnings and expenses. If you apply for insurance through us, we may also collect health information (with your consent).


Purposes for which we may collect, hold, use and disclose your personal information

We collect, hold, use and disclose your personal information to enable us to:

  • assess your application for finance and arrange that finance (either by providing it ourselves or through a third-party funder);
  • manage your finance and our relationship with you generally.

Additionally, we may collect, hold, use and disclose your personal information to:

  • administer your insurance policy and assess insurance risks or claims;
  • review and maintain our systems and infrastructure;
  • research and develop new products and services;
  • undertake activities relating to funding and capital requirements;
  • manage dispute and complaint resolution, and assist other credit providers;
  • offer you other products and services and allow our associated or selected third parties to promote their products and services to you;
  • participate in the credit reporting system and provide information to credit reporting bodies;
  • enforce our rights, including debt recovery;
  • meet legal and regulatory requirements;
  • compile statistical data such as credit scoring information.

How do we collect your personal information?

Where reasonable and practical, we will collect your personal information directly from you. We may also collect it from finance brokers and other people such as accountants and lawyers.


Do we disclose your personal information?

To maintain a successful business relationship, we may disclose your personal information to other organisations that provide products or services we use or market. We may also disclose your information to any organisation that has, or is considering having, an interest in your finance or in our business.

Where acting as a broker or intermediary, we may disclose your information to prospective credit providers or insurers as necessary to obtain finance and insurance on your behalf.

We may disclose your personal information to:

  • any disclosed or undisclosed principal on whose behalf we act as agent, and their related bodies corporate;
  • prospective credit providers and intermediaries;
  • third-party service providers (e.g. printing, mailing, call centres);
  • credit reporting bodies (e.g. Illion, Equifax, Experian);
  • associated businesses that may want to market products to you;
  • IT and infrastructure service providers;
  • your representatives (e.g. finance brokers, lawyers, accountants);
  • anyone with your consent;
  • government authorities where required by law;
  • investors, agents or advisers;
  • your employer, referees, or identity verification services;
  • our related entities based overseas;
  • legal and market research service providers;
  • assignees or potential assignees;
  • suppliers or vendors relating to financed goods or services;
  • organisations involved in debt collection or securitisation;
  • insurers, assessors, underwriters, brokers;
  • regulatory bodies and law enforcement agencies in Australia and overseas.

Before disclosing your personal information, we will take reasonable steps to ensure:

(a) the recipient has a commitment to protecting your information equal to ours, or
(b) you have consented to the disclosure.

We may use cloud storage to store your personal information, and this may involve storage overseas.


Direct marketing

From time to time, we may use your personal information to provide you with information about finance, offers, organisational updates, or new products and services.

Updating your personal information

It is important that the personal information we hold about you is accurate and up to date. During our relationship, we may ask you to inform us of any changes. You may also contact us at any time to update your details.


Access and correction to your personal information

You may request access to any personal information we hold about you at any time. We may charge a fee for retrieving and supplying this information.

We typically respond within seven days of receiving a request. In some cases, access may not be granted, for example, if it relates to legal proceedings or if the request is vexatious. We will provide an explanation if we deny access.

If your information is incorrect, inaccurate or outdated, you may request that we correct it. We will generally correct information immediately or provide an initial response within seven days, with final resolution within 30 days.


Using government identifiers

If we collect government identifiers (e.g., tax file numbers), we will only use or disclose them as required by law. We do not use them to identify you.


Business without identifying you

In most cases, we need to identify you to do business. However, where lawful and practical, we may allow you to interact with us anonymously (e.g., general enquiries).


Sensitive information

We will only collect sensitive information (e.g., health, racial or ethnic origin, political opinions) with your consent.


How safe and secure is your personal information that we hold?

We take reasonable steps to protect your personal information from misuse, loss and unauthorised access, modification or disclosure. This includes secure storage in both paper and electronic form.
